Principal Government Lawyer


The Office of the General Counsel (OGC) is responsible for all legal services and advice required by the department. This includes the coordination of legal services and the provision of internal legal advice including contracts and grants management, statutory interpretation and regulatory advice, legislative development, debt recovery, investigations and enforcement and litigation and claims resolution. It also manages and advises on matters relating to Freedom of Information and privacy.

The Job
The OGC supports the department to achieve its outcomes and program objectives through the provision of a wide range of legal services. We are currently looking for an experienced lawyer and manager to lead our Employment and Litigation & Dispute Resolution team. In this role you will manage a small team of lawyers and work collaboratively within the Office of the General Counsel under the supervision of the General Counsel. The team manages and advises on a wide range of matters for the department in the following areas:

Employment and industrial law
The team deals with a wide variety of Commonwealth employment, industrial and WHS matters. This includes advising on disciplinary matters, performance issues, and interpretation issues under the department`s Enterprise Agreement. We also represent the department in contentious matters before the Fair Work Commission. Key legislation we advise on includes the:

• Public Service Act 1999;
• Fair Work Act 2009;
• Public Interest Disclosure Act 2013;
• Work Health and Safety Act 2011; and
• Safety, Rehabilitation and Compensation Act 1988.

Administrative review and litigation
The team manages and advises on a range of administrative law review matters including:

• applications for internal and external review under the Biosecurity Act 2015;
• applications for discretionary assistance under the Scheme for Compensation for Detriment caused by Defective Administration and the Act of Grace mechanism;
• the department`s responses to inquiries and investigations by the Commonwealth Ombudsman, AHRC and other administrative law review bodies; and
• a small litigation case load as well as a range of other contentious matters.

This role will require you to work collaboratively within a team, supervise and develop a small team of Senior Government Lawyers and Government Lawyers and work under the limited direction of the General Counsel. This position would suit a lawyer with a minimum of 5 years of relevant post-admission experience.

Knowledge and experience
The successful candidate will be able to demonstrate strong legal skills and experience in the practice areas outlined above. The successful candidate will also be able to demonstrate experience in successfully leading and managing a small team of lawyers to produce high quality legal support and practical outcomes for clients.


Mandatory Qualifications
To be eligible for this position you are required to hold a degree in law and be eligible to hold an ACT legal practising certificate.
